The campaign team and I sent a letter to Mr. Bobby Scott to address the issue of Mercury levels in our nearby waterways and ask why he hasn't been more vocal in opposing coal in the district. I opposed the coal plant in Dendron because of the information held in this report. Mercury levels are safe if held below 1 gram per kilometer squared. As this report shows, the 3rd District has higher mercury levels than what is considered safe, especially in comparison to the rest of Virginia.

Dear Congressman Scott,
We are writing to you on behalf of our concern over the excessive levels of mercury contaminating the 3rd District of Virginia and the increased vulnerability of toxic exposure this has placed on Virginians, as well as others. According to the Virginia Department of Environmental Quality’s (DEQ) Revised 2008 Report it is clear that 3rd District has some of the highest mercury levels in the Commonwealth. It is well known that mercury is an extremely lethal substance and has been inarguably linked to a myriad of adverse health conditions. It is widely recognized that, like lead, even small amounts can result in lowered IQs, still births, and infant death in young children. In addition mercury acts as a carcinogen, a mutagen, and compromises the immune system.

Mercury is especially disturbing because once accumulated in living organisms, like fish and humans, it never leaves the system. Rather, it incrementally increases throughout the organism’s lifespan. Therefore, the only sensible course of action is to keep “bioaccumulation” at subcritical levels that are not expected to manifest in ill-health or death.

Ultimately, this is another challenge facing the Chesapeake Bay but the most critical water systems may be riparian, like the 3rd District’s Blackwater River and several James’ River tributaries. These rivers are at increased risk because the acidic conditions of their waters have been shown to greatly enhance the bioaccumulation of methyl mercury, which is the most “bioavailable” form of the substance.

As such, the single largest concern is the environmental health issues related to sustenance fishing within these rivers. This also has dramatic impact on the lifestyle and living standards of the many poorer individuals who have traditionally depended on these nutrients. Furthermore, this is destined to threaten small businesses that draw from the biological resources of these rivers. To a lesser degree there is also logical and scientific reason to be concerned about exposures resulting from recreational activities and irrigation use.

Surely, these issues should be of extreme concern to any US Congressperson who represents the 3rd District of Virginia. In addition, these issues clearly come under Federal jurisdiction because of past legislation and the fact that contamination often crosses State boundaries. As such, there is an immediate need for comprehensive action, which takes into account all significant point and non-point sources of contamination affecting the 3rd District.

This includes confronting the local sources of contamination that are the largest polluters. True, interstate contamination from West Virginia and Virginia flow downstream, and downwind, to the coastal regions of 3rd District and parts of North Carolina, in addition air-born mercury travels from as far as China. However, the boundary patterning of contamination, as shown in the Revised 2008 DEQ Report, clearly identifies that the major sources of mercury pollution is from within the District.

The story of mercury contamination in the 3rd District is complex. One of the most recognized sources of mercury pollution are coal fired power plants. In 1990, under President G.H.W. Bush, Congress amended the Clean Air Act to include mercury. In 2000, under the Clinton administration, the US Environmental Protection Agency (EPA) issued a finding that linked coal burning power plants to mercury contamination. This finding manifested in an EPA mandate to significantly reduce coal-fired power plant mercury emissions by target dates 2010 and 2018. However, under President G.W. Bush, the EPA used another section of the Act to remove these power plants from the list in 2004; and this annulled the mandates to lessen mercury emissions.

Pursuant, of this action several States, Native American tribes, and third parties filed suit against the EPA. Meanwhile, the EPA simultaneously sought to circumvent the issue by hatching an imprudent scheme to cap and trade mercury. This case, which came to be known as The State of New Jersey, et al. v. the EPA, ultimately resulted in the United States Court of Appeals for the District of Columbia ruling against the EPA in 2008. Throughout the process Democrats and Republicans in Congress avoided making any meaningful compromise or demanding interim protective measures.

Upon the Court’s final ruling the EPA was compelled to sign a Consent Decree in early 2009. However, review of this Decree allows until late-2011before the EPA must publicly announce Clean Air mandates for coal-fired power plants and until late-2012 before they will come into effect. Furthermore, the ruling leaves many loopholes for extensions and continued foot-dragging. Once again, Congress, the EPA, and the Obama Administration have chosen to sit quietly without demanding expedited action or interim protection. In our opinion, these two decades of intentional mercury contamination is unacceptable and disgraceful, and the poisoning of the American Public should be ended immediately!

Possibly the most surprising source of point contamination within the District are two industrial accidents. Both the Brenco Bearing facility and the Chaparral Steel recycling, near Petersburg, engaged in superheating metals, including mercury, which resulted in the unnecessary and completely preventable release of large quantities of the toxin into the atmosphere. It is by no coincidence that even today extremely high rates of mercury can be found near the location of these factories. While it is true that both companies have quietly taken action to stop future contamination they have not been held accountable nor has compensation been extended for past, present, or future damages.

Finally, no course of action would be sufficient without recognizing the need for controlling non-point sources of mercury and heavy metal contamination. In recent years poorly manufactured products have permeated the global market. These consumer goods have been determined to contain dangerous and impermissible amounts of mercury, among other harmful substances. It is here that the government must ensure that these products never enter the marketplace, as continued apathy will only jeopardize the citizens of the 3rd District, as well as elsewhere.

To be frank, we are concerned by your lack of publicly addressing this issue, let alone, the absence of advocating any governmental measures to help ensure the commerce and health of constituents residing inside of your District. We sincerely hope that you will join us in our effort to address this issue as the severity of the situation should know no political affiliation. As such, we would be happy to meet with you at any time to discuss the issue and develop a coalition which we know will be effective in Washington.

The members-only gothic nightclub known as Fallout in Richmond Virginia is opening its doors to the public for one night only in order to host a 3rd District Congressional Debate and afterwards a fundraiser for the "James Quigley for Congress" campaign. The doors open to the public at 6pm, the debate (John Kelly accepting to attend so far) will be at 6:30pm, and the celebration continues after 8pm.

There will be live streaming video for the debate portions. Those wishing to take photographs or film the celebration must show a press badge upon entering, but the press is otherwise welcome to attend.

Come and promote James Quigley for his bid for Congress and to celebrate Liberty! We hope to make the start of this event the Greatest Debate of 2010!

Open Letter to Doug Wilder



Attached is my open letter to the retired Governor Doug Wilder. He is not an easy man to reach, but I hope this letter is eventually placed into his hands.

I wish to push for his proposed Slavery Museum to find its home at Fort Monroe in Hampton Roads. Such a museum would bring beneficial tourism to this region, and makes historical sense as the first slaves came to America through Fort Monroe.

Tim Schettino (my co-worker on this proposal) and I have further proposals worked on ideas for land use on the fort in the drive to make the property self-sustaining financially. We will send these additional details out in a future e-mail.

Shut Down the Federal Reserve Now

This is an important article, since Mr. Evans-Pritchard has been a huge cheerleader for the Fed's Quantitative Easing. If he has changed his mind now, then it may already be too late to save the dollar's current value. Hopefully the citizens will wake up soon to realize that the real fight isn't about Mosques in NYC, or DADT, or Tea Party vs NAACP spats. As Lord Acton once said, "The issue which has swept down the centuries and which will have to be fought sooner or later is the people versus the banks." Let it be now. Shut down the Federal Reserve.

The Republicans just keep trying to sabotage this campaign. First, they scrambled to find a candidate to run after they found out that I intended to do so. Then the Republicans resorted to applying pressure to try to get me to step out of the race. Now they’ve decided to physically impact my campaign. Nicole and I went to the Nottaway Pow Wow in Surry County Sept. 19, 2010. We planted two signs at the entrance road before we stepped in to participate. When we left the event, we saw our signs uprooted and tossed to the ground. What we found was the Republican’s signs put up in their place. These signs were not there when we entered the Pow Wow. Let’s hear it for the Republicans… if they can’t win an election by beating them, they’ll win by cheating them.



In their defense, the Republican campaign in the 3rd District is going poorly and the leadership of the 3rd District has riled its members up by blaming my involvement for their shortcomings. They keep saying that I’ll split their vote, which is comical since I was campaigning months before their candidate decided to campaign in a district he doesn’t even reside in. So much for the Republican promise to restore honesty to Washington DC. How is he going to make that happen if he can’t even have his volunteers conduct themselves honestly in Surry County?

Busy, busy, busy...

I just finished an interview with Channel 13 news in Norfolk (WVEC) which will be airing at 5pm and 6pm today, with another broadcast at 1pm on Sunday. If anyone can record these and send me a copy I'd be appreciative. If not, the campaign team will try to procure one from Channel 13 directly.

I need volunteers for seven events. We tried to call everyone, but this is in case we missed anyone.

(1) We will be meeting tonight at 7pm at the Campaign Headquarters (1929 Coliseum Drive) to distribute flyers and yard signs to our volunteers. At around 7:20pm a number of us are going to leave and head to the Indian Festival at Buckroe Beach to pass out flyers, for those interested.

(2) We will be forming up again at 815am-830am Saturday morning at the Campaign Headquarters in order to head to the Denbigh Day Parade. We will be passing out more flyers and candy. The parade should be over by noon.

We are splitting up into four groups tomorrow. Some in our campaign are heading out to the (3) Freedom Fest with Judge Napolitano in Richmond. (4) Others are going to stay at a table at Denbigh Day and pass out flyers and Libertarian Party information. (5) The third group will be going or meeting with Nicole and I after the parade to meet with folks in the Southside Community in Richmond for a get-together they are having in the afternoon. I will be allowed to speak to that group sometime around 2pm. (6) A fourth group will be going to Buckroe Beach in Hampton to continue with the Indian Festival.

(7) On Sunday I'm making a road trip through the counties to pass out literature for those that want to join me.

My parents did not raise me to ask for money and I don't enjoy doing so because this country is in a Depression and times are tough. I tried to run this campaign on a shoe string budget. But there are materials that our staff needs and upcoming events we want to involve ourselves in that require funds. If I can get just $100 from each person that views this post, the campaign staff and I should have enough funds for needed signs, T-Shirts, and flyers up until the elections.

Newsletter Update



Sorry that this newsletter came out a few days later than the campaign team intended, but that is because of how busy we've been. We'll get the next one out on time. Because of this the dates might seem confusing. I had the honor of speaking to the Coalition for Justice for Civil Rights the Monday before last, not the most recent one.

Thanks to Trevor Benson for setting us up to hand out flyers in Surry last weekend during the Pork, Peanut, and Pine Festival. Thanks also to Darrel Whitaker, Britt Howard, and my family for joining Trevor and I in handing out flyers and talking to our fellow citizens and vendors about the campaign.

A special thanks to all of those that hit three different locations in one night! This Tuesday we had Mike Johns represent me at the Campaign for Liberty meeting. My wife Nicole Quigley, Darrel Whitaker, Glenn McGuire, Sanford and Christine Pankins, Mike Prunty, Robert Harding, and Robert Alexander represented the James Quigley for Congress campaign team at the New Republic Patriots social. Also, thanks to the Richmond Crusade for Voters for allowing me to speak to their respected group. I also want to thank Carolyn Worssam and Patrick Ward for accompanying me tonight. Rudy Langford was also supposed to attend the Richmond meeting, but could not come due to medical reasons. We ask that people pray that he will be fine and active once more.

As a Libertarian, I am supportive of legislation that ensures government's observance of all rights for all people.

Weekly Update #10



I apologize for the old news in this weekly update. I wrote the newsletter on Friday and the campaign team spent the weekend putting it in the proper format. We had not anticipated that the Greek bailout would go from the proposed $60 billion to $1 trillion over the weekend. The Federal Reserve opened its currency swap window right after this announcement, and the European Central Bank cannot print money as easily as the Fed. At this time, we have no idea how much of the $1 trillion is going to be funded by the US taxpayer and we will most likely not know until we audit the Federal Reserve. Congress needs to reign in the Federal Reserve System now!

Answers to a Question from a Concerned Citizen

These questions were submitted to me by a concerned citizen. I answered them and post the exchange here:

How would have voted on the invasion of Afghanistan?
How would you have voted on the invasion of Iraq?




I was a young officer during 9-11 and also still felt my New York City roots as I had family there, so it won't come to a surprise that I fully supported the invasion of Afghanistan and also Iraq. We have been fighting for nearly a decade now, and there are many things that I wish we had done differently, but hindsight is 20/20. I also lost an amazing friend in Afghanistan named Tamara Archuleta. She was the best friend and squadron mate of another close friend of mine, and was also engaged to marry another Academy alumni that I had known. She left behind a child from a previous marriage gone bad, and I often wonder how that child is coming along. My point is that my feelings towards war are not the same as they were in 2001. I would not say I've grown wiser, but I will say I've grown a bit more cynical. Instead of trying to imagine my actions if I could be transported into the past or if history repeated itself, I would rather repost an answer I gave on what I would do in Iraq and Afghanistan right now-

War in Afghanistan. No.

Although I agree with our response to 9-11 and am proud to have participated in Operation Enduring Freedom, I am against further large scale involvement in Afghanistan for three reasons.

(1) Our economy is insolvent and we must take drastic measures to pay off our debts and maintain the strength of the US dollar. Large scale involvement is too costly.

(2) Our forces have done an admirable job, but our logistical system, maintenance upkeep, and combat training have all suffered because of the length of time our forces have been deployed. To keep our edge, we need to reconstitute our forces.

(3)The two regimes we are supporting, that of Karzai in Afghanistan and Zardari in Pakistan, have a history of corruption and have made several mistakes that have caused uprisings against their rule in the countries they control. Events in Pakistan have gotten out of Zardari's control, and there is now a humanitarian crisis developing along the
Afghani border.

I cannot support a large scale conflict against a population where the lines between an al-Queda terrorist and man fighting against a corrupt government are blurred.

If elected to Congress I pledge to seek the removal of the military from Afghanistan and Pakistan, except for small scale operations specifically targeted at terrorist cells planning operations against US citizens abroad or on US soil. Also, although I am not
supportive of Karzai or Zardari, I would not want to entirely abandon the Afghani people and would also be willing to see the US provide some assistance in developing a system of irrigation and farming to territory controlled and secured by Afghan warlords that treat their various ethnic groups humanely and treat our own aid workers with respect. Finally, there needs to be a more open system of selecting aid groups and construction companies, instead of us picking the same firms whose board of directors once seated a high ranking politician.

War in Iraq. No.

I am also a veteran of Operation Iraqi Freedom, and was proud to finally see Saddam Hussein and his Baath Party removed from power, and am even more proud that Iraq has become a functional country. It will not have the internal stability of the United States. Stability closer to what we see in Jordan seems to be coming to fruition. Although corruption is
still an endemic problem, the Parliamentary system in Iraq is healthier than the kleptocracy that is Karzai's government in Afghanistan. I would want to see us leave Iraq for the following reasons:

(1) The insolvency of our financial system needs immediate attention. (2) I would not want to see the Iraqi government become complacent of US protection such as what has happened in Western Europe. Western Europe is so dependent upon US power that it was not able to respond to the crises in the former Yugoslavia and embroiled us into the conflict, and is also unable to stand up to Russian threats and power plays. It is time to leave Iraq so that our forces do not become a crutch, and so that we do not become involved in conflicts that the Iraqi government might start.

If elected to Congress I pledge to see the reduction of forces from Iraq except to provide security to our embassies.


What is your position on abortion?

Personally I do not condone abortion. Legislatively, I would push for an end to all government funding of abortion.

Do you live in the 3rd District?

Yes.

What is your position on the Patriot Act?

The Patriot Act has been abused and has allowed the government to invade the privacy of US citizens. It should be repealed.

What should we do about the border?

Take the soldiers from Iraq and Afghanistan and place them on our borders. Then go after the businesses that are exploiting illegal immigrants for cheap labor and promoting unsafe work environments. If we tighten the borders and go after those that are perpetuating the problem we should be able to stem the tide. After that, we can see if we can make the beauracracy a simple process so more illegal immigrants are encouraged to follow the legal process of citizenship, while deporting those who continue to violate our laws. It is inhumane for us to continue this exploitation and it will lead within the next generation to an increase in ghettos consisting of second generation Americans with no chance of a future.

What should the US do about Iran’s apparent attempts to develop a nuclear weapon?

If we truly feel that Iran is attempting to develop a nuclear weapon and that it will be used against the United States and its citizens, then we should just strike the sites and go home. Iran's posturing should not be used as an excuse to expand our global presence indefinitely.

What percentage of my income should the federal government get from me?

God is a higher authority and only asks for 10%. The federal government should request less than that. We also need the government to stop taxing its citizens with inflation created through the printing press. Inflation makes it easier for the government to pay its debt, but harder for the citizen to survive. Inflation is a tax.

Update: Someone asked me if I support a tax on income. I do not, but saw the above question instead as an overall tax burden.

New Endorsement

I just received the endorsement the Newport News activist, Minister Darrel Whitaker. He was kind enough to send a copy of an e-mail about me that was sent to his readers and I have his permission to post it here:

After talking to Mr. Quigley about a Felon's right to vote and the eighth amendment, I met with him and some of the members of the Libertarian Party. I was curious about other rights of citizens being perverted. The meeting was extremely informative. I found that the Libertarian Party is the only Party that is for change, but not the change I expected. This was really not a change to something new, but a change to something old: the original interpretation of The Declaration of Independence and The Constitution of The United States of America.

These documents have been the cornerstone of this country's belief in its freedom. Sadly these documents have also been the most distorted and perverted of this country's history. Through their political appointments of Supreme Court, state and local judges, and the abuse of their powers on every level, politicians have betrayed the public trust.

The evidence is quite clear to those of sound mind and knowledge of the history and intent of the Constitution and Declaration.

This Government has become exactly what the framers of these documents were freeing themselves from in the first place when they inserted safe guards to insure government's control by the people. The Bill of Rights for instance, has been interpreted as rights controlled by the government, rather than rights to be protected by the Government. They have turned a nightmare into the unalienable rights mentioned in The Declaration of Independence: life, liberty and the pursuit of happiness. This Government has seized power; complete power over our lives. Our life, liberty and the pursuit of happiness has become their choice, not their responsibility.

The Libertarian Party, in my opinion, represents a more citizen-oriented Government. It pushes for the choice of what kind of life we may live, while protecting our liberty in our pursuit of happiness. It is the only Party advocating the return of the government to the people. If you are poor, it is the best chance for you to rely on your own ability to navigate your own life, as you attempt and begin your climb to a better life for your family. If you are middle class it will help to make your climb more solid, as you build family wealth for the next generation and know that the government can't just take it from you. If you are rich through your own hard work, well the sky is the limit.

I strongly recommend that poor people and people of color take a closer look at the Libertarians. AS a matter of fact, everyone should take a closer look at the Libertarian Party.

The New Healthcare Law

I've written my thoughts on the Healthcare plan, but I wanted to post some quotes from others who 'get it':

From the Hugh Hewitt Show's interview with Mark Steyn on March 25th, 2010:


Hugh Hewitt: Now they tell us, Mark Steyn. It’s a spread the wealth around bill.

Mark Steyn: Yeah, that’s right. I thought it was supposed to spread the health around, but as you say, it’s going to be spreading the wealth around. I mean, I think this is right, that this is, that the concept behind this bill is actually an income redistribution bill. If you look at the additional taxes that will be imposed on small businesses, and when people say the very wealthy, by the way, they’re talking…people think you mean Warren Buffett and Bill Gates. It’s not. It’s going to be a lot of small businesses, and a lot of guys doing various kinds of jobs where they employ three or four people who are going to have additional regulation, and additional taxes, and additional costs in pursuit of this grubby deal. And by the way, I don’t want to be told by a Senator that I’m too wealthy, because Senators in this country are a disgrace to republican government and the concept of citizen legislatures. They prance around with these vast retinues of the size of an average Gulf emir. Max Baucus hardly ever has to do anything in his life that requires him to reach in his pocket and get out a $20 dollar bill, or write a personal check. I don’t want to be told by Senators, I don’t want to be told by Senators that I’m too wealthy, and that’s why they need to over-regulate me, and overtax me to give it to their preferred constituency groups.

Hugh Hewitt: And it’s not going to go to…you know, the older people on Medicare Advantage, who are going to get their Medicare Advantage chopped off, and their $500 billion dollars of benefits deleted, so that the unions can keep their Cadillac plans…

Mark Steyn: Right, right.

Hugh Hewitt: They’re not, this isn’t wealth distribution for them. It’s for preferred constituents.

Mark Steyn: Yes, and that’s what this bill…this is why, as I said last week, Hugh, this is why it’s actually worse than the sort of equality of mediocrity that, the equality of awfulness, in fact, that characterizes a lot of socialized health care systems around the world, because this is worse than that. You’ve got all the smoke-filled room horse trading by which certain preferred interest groups have got opt outs from the most punitive aspects of this legislation, depending on how plugged you are to the Democratic Party. And this is the lie, by the way, to go back to this idiot, Baucus. The really wealthy guys have got the workarounds. They know how to pick up the phone and call someone in Washington who can make the problem go away. It’s the guys holding up this country, it’s the small businessmen holding up this country who haven’t got the workarounds, who can’t afford the expensive lawyers and lobby groups, that can call someone like Max Baucus and make the problem go away. So if you think…anybody who’s stupid enough to think this is a way of sticking it to the mega-wealthy, to the Wall Street plutocrat, to the guy from the Monopoly board, this isn’t going to affect them. They’ve got the workarounds. You don’t.

James Quigley on the Healthcare Bill

Nicole and I did something unusual and dropped in on an Organization for America meeting last night. We thought it would be a good opportunity for us to hear the talking points for the supporters of the healthcare bill since they are pushing once more for its passage. The current Democratic incumbent for Virginia’s 3rd Congressional District showed to speak and said the following:

1.) That if the public option was not included in the bill they would soon attempt to vote for, that it would be introduced later in another bill.
2.) That the public option was to be put into place in order to break the power that the insurance industries currently possess, in order to bring down costs.
3.) That the public option would not be a government takeover of healthcare since it would instead allow a mechanism called the Exchange where several picked insurance companies would sell cheaper healthcare in a government-regulated market.
4.) That everyone will be put under healthcare. If an insurance company is too expensive, an American can opt to instead fall under a cheaper system provided by the Exchange.
5.) That the Democrats would not support allowing insurance companies to sell insurance policies across state borders because the Democrats say there would not be a cost reduction for coverage by doing so.

The audience applauded the speaker at the end of his speech. It was amazing to hear so many of my fellow Americans give praise to a proposal that would further place them into bondage. This bill is intended to strengthen the hold of a select few well-connected health insurance companies at the expense of the American citizen and smaller insurance companies that cannot afford lobbyists or large campaign contributions. Those in the government will have strengthened control over our lives while the insurance companies that are part of the cartel will profit from the destruction of the competition.

Let me break down what is really going on:

1.) The bill is not perfect because it has exploitable loopholes and also graft to buy support, but the supporters in Congress will try to pass it now and fix it later. This reminds me of the Federal Reserve Act which was supposedly written to regulate our financial banking industry, but which was ‘fixed’ later in order to strengthen a shared monopoly, also known as a cartel, against its competitors.
2.) The cartel of insurance companies will be strengthened and subsidized, which will destroy their competition. Any insurance company not able to buy their way into this program will be made an example.
3.) This government sanctioned cartel will work under a system named the Exchange. This will be a private corporation working alongside the government in a similar fashion of the Federal Reserve System.
4.) The citizens will be coerced or mandated to be placed under the Exchange. The Exchange will use its relationship with the government to undersell its competitors.
5.) Only the Exchange will be able to sell policies across borders because of its relationship with the government. All other insurance companies not part of the government-sponsored system will be denied access to do the same. Vive le Exchange! Vive le Roi!

Our government has decided to sell the American citizens to the corporate interests for greater power over our lives, bribes through campaign donations, and behind the scene benefits.

When elected to Congress I will vote down such proposals. When elected to Congress after this passes, I will undo as much of the damage as I am able in order to restore the LIBERTY of our citizens. Our issues of healthcare stem from the rationing and shared monopoly of a few special interest groups. Costs are high because demand is high while we maintain a low supply of necessary goods and services. We need to find ways to increase the amount of pharmaceuticals, doctors, and medical equipment to support our demand via a more competitive market. If the proposed healthcare bill is passed into law, or if our current broken medical system is allowed to continue without reform; then the government and politically connected profit and the American citizen loses. AGAIN.

A Libertarian Defense of Delegate Bob Marshall

Lately, there has been a dangerous trend in this country to limit free speech, with calls for representatives to resign and administrative officials to be removed from office. The latest example of this is occurring in Virginia after Republican Delegate Bob Marshall made a statement against the state funding of Planned Parenthood. The transcript of his discussion had religious connotations that some have called ‘hate speech’ and there are calls for his resignation.

Mr. Bob Marshall was quoted as saying that the “number of children who are born subsequent to a first abortion who have handicaps has increased dramatically…Because when you abort the first-born of any, Nature takes its vengeance on the subsequent children. In the Old Testament, the first-born of every being, animal and man, was dedicated to the Lord. There’s a special punishment Christians would suggest, and with the knowledge they have from faith has been verified by a study by the Virginia Commonwealth University. First abortions of the first pregnancy are much more damaging to the woman than latter abortions.”

Mr. Marshall is now under fire from his own political party, with Virginia’s Republican Governor Bob McDonnell taking a shot at the delegate, calling the delegate’s words offensive and wrong. For a political party that beats its chest about supporting the Constitution, there seems to be a sudden lack of consideration for the 1st Amendment and Mr. Marshall’s right to free speech. The delegate identifies himself as a devout Catholic, and so his faith is going to shape his thoughts and beliefs. There are plenty of analogies in the bible of God punishing individuals and civilizations for not following the bible’s guidelines. In addition to his religious views, Mr. Marshall also cites scientific data from Virginia Commonwealth University which has influenced his opinion. For Delegate Marshall to change his belief and thoughts on abortion when it comes to his personal studies and experiences is akin to asking him to toss away a portion of his own self-identity. This is why freedom of speech is so important, because it is connected to individualism as well as healthy political dialogue. Instead of lampooning free speech, Governor McDonnell would have done us a better service by quoting Voltaire as I would have done, “I do not agree with what you have to say, but I’ll defend to the death your right to say it.”

If Delegate Bob Marshall attempts to force his morality onto the population through legislation then it would be time for us to speak out against him. However, his fight against the state funding of Planned Parenthood should be supported. The government forces taxpayers to participate in government-sponsored population control. Taxpayers can decide to help change the laws that use their money to fund programs they are morally against, accept this state of affairs, or stop paying taxes and go to jail. Legislative change is the only logical recourse to those who wish to object the usage of their taxpaying dollars.

Finally, I’m more concerned with a politician’s legislative record than his recorded transcripts. Recently, Delegate Bob Marshall pushed a bill to support states rights in regards to a takeover of health care by the Federal government. This bill is called HB-10, the Virginia Healthcare Freedom Act (VHFA), and it states that "No law shall restrict an individual’s natural right and power of contract liberty to choose private health care systems or private plans."

Instead of taking his time to lampoon supporters of my natural rights, I’d rather see Governor McDonnell support Delegate Bob Marshall's right to free speech and HB-10 legislation. While he is at it, the governor could also push his party hard to pass Democratic delegate Ward Armstrong's HB-651 and HB-652, which gives the individual greater protection from eminent domain. Our representatives must aggressively restore individual rights, rather than actively denying them.

Text of a recent interview

What is motivating you to run?


I believe that the Republicans and Democrats are failing to bring up the insolvency of the US Government and financial system and the reduction of our natural rights. The country is broke and a Depression is just beginning as the problems in the economy have been papered over rather than addressed. However, I believe both major political parties are unable to
address these issues because those that have profited from the mismanagement of the financial and government system are the same people who give the most money to our ruling political class in the form of campaign donations and other perks. I believe speaking about Bobby Scott’s closeness to corporations and financial institutions will give me an edge in his district that a Republican would not for fear of losing contributions.

No. I hope to encourage other citizens to do so, however.

1. Health care reform bill. Yes and No.

Yes, our current healthcare system has many problems but there are many free market solutions to resolve these difficulties that have been created in part by improper regulatory oversight and government control.

No, I do not support any of the lately debated healthcare reform proposals in either the House or Senate because these current proposals increase government control, increase cost of access to medical care, and actually decrease availability. Once the government can directly control the funds for something as necessary as medical care it will do all it can to reduce service in order to increase government profit that will be spent on pet
projects and patronage. It will also inherit a later justified control for behavior to keep medical costs down.

There are already many examples of Government using this self-assumed authority to justify protecting people from themselves. The British government passed such laws, saying that since the British government was footing the bill it had the right to take all actions necessary to reduce health care costs.

If elected to Congress I pledge to solve the primary cause of health care issues, which is more a problem of a supply and demand caused by government interference. I will seek legislation to legally allow citizens to easily transport pharmaceuticals from countries where they can be purchased for cheaper, remove roadblocks that make more numerous small
and middle sized pharmaceutical companies impossible, and allow insurers to be able to sell their services across state lines. Also, the US needs to reform malpractice suits. The Constitution has laid out the tools for addressing most of these issues, many of the root causes of our current difficulties has been a reinterpretation or ignoring of the Constitution.


2. Stimulus (aka: H.R. 1, the American Recovery and Reinvestment Act of 2009).

No, and this is the main cause of why I am campaigning. This, coupled with other recent legislation, is the greatest transfer of wealth our nation has ever seen from the poor and middle classes to the elite and politically connected. I no longer believe that our country is based on free market Capitalism, and have not since October 3rd of 2008. Those in government call our system Capitalistic, but there is nothing free market about the restrictions we place on small and middle-sized businesses while giving large corporations and financial institutions bailouts, subsidies, and tax breaks their smaller competitors never see. Our financial system is controlled and manipulated by the US Government and influenced by failed, but politically connected businessmen. Our country is a Corporatist State.

If elected to Congress, I pledge to vote down any and all bailouts and subsidies. To paraphrase Gerald Celente, “This is America and you rise and fall on your own merit.”

3. War in Afghanistan. No.

Although I agree with our response to 9-11 and am proud to have participated in Operation Enduring Freedom, I am against further large scale involvement in Afghanistan for three reasons.

(1) Our economy is insolvent and we must take drastic measures to pay off our debts and maintain the strength of the US dollar. Large scale involvement is too costly.

(2) Our forces have done an admirable job, but our logistical system, maintenance upkeep, and combat training have all suffered because of the length of time our forces have been deployed. To keep our edge, we need to reconstitute our forces.

(3)The two regimes we are supporting, that of Karzai in Afghanistan and Zardari in Pakistan, have a history of corruption and have made several mistakes that have caused uprisings against their rule in the countries they control. Events in Pakistan have gotten out of Zardari's control, and there is now a humanitarian crisis developing along the
Afghani border.

I cannot support a large scale conflict against a population where the lines between an al-Queda terrorist and man fighting against a corrupt government are blurred.

If elected to Congress I pledge to seek the removal of the military from Afghanistan and Pakistan, except for small scale operations specifically targeted at terrorist cells planning operations against US citizens abroad or on US soil. Also, although I am not
supportive of Karzai or Zardari, I would not want to entirely abandon the Afghani people and would also be willing to see the US provide some assistance in developing a system of irrigation and farming to territory controlled and secured by Afghan warlords that treat their various ethnic groups humanely and treat our own aid workers with respect. Finally, there needs to be a more open system of selecting aid groups and construction companies, instead of us picking the same firms whose board of directors once seated a high ranking politician.

4. War in Iraq. No.

I am also a veteran of Operation Iraqi Freedom, and was proud to finally see Saddam Hussein and his Baath Party removed from power, and am even more proud that Iraq has become a functional country. It will not have the internal stability of the United States. Stability closer to what we see in Jordan seems to be coming to fruition. Although corruption is
still an endemic problem, the Parliamentary system in Iraq is healthier than the kleptocracy that is Karzai's government in Afghanistan. I would want to see us leave Iraq for the following reasons:

(1) The insolvency of our financial system needs immediate attention. (2) I would not want to see the Iraqi government become complacent of US protection such as what has happened in Western Europe. Western Europe is so dependent upon US power that it was not able to respond to the crises in the former Yugoslavia and embroiled us into the conflict, and is also unable to stand up to Russian threats and power plays. It is time to leave Iraq so that our forces do not become a crutch, and so that we do not become involved in conflicts that the Iraqi government might start.

If elected to Congress I pledge to see the reduction of forces from Iraq except to provide security to our embassies.

5. Lilly Ledbetter Fair Pay Act of 2009. No.

I have sympathy for victims of discrimination. However, this particular law focused on statute of limitation rather than on what is or isn’t actionable in court. Previously you had to find a violation within the last 180 days. Ledbetter waited years to sue, and the
courts ruled she waited too long; they did not rule on whether discrimination had occurred. However, the US government has a history of protecting companies that are politically connected while giving undo scrutiny to those who are opposed to actions the US government takes and therefore it cannot be trusted with another tool that allows it to act against a private business or individual.

For a recent comparison let us look at two businessmen, Tim Geithner and Joseph Nacchio. "Turbo Tax Timmy" Geithner was crucial in getting financial support for the first half of the bank bailouts, and afterwards was made Secretary of the Treasury despite the
finding during his confirmation hearing that he owed tens of thousands of dollars in taxes. Compare this to Joseph Nacchio, former CEO of Qwest, who refused to provide the communication records of his customers to the Bush administration. He declared that such a request was against his customers’ rights to privacy. Shortly afterwards he was arrested after allegations from the SEC that he had practiced insider trading. This by the same SEC that missed Bernie Madoff despite numerous calls warning them of his fraud and has yet to investigate how Goldman Sachs made its profits before and during the current financial crisis.

If elected to Congress I would seek legislation that would better protect individuals from libel suits while finding a way to maintain the Constitutional access to the courts; so that people could speak against, post on blogs, or publish literature about companies that have ill-served them. I have greater trust in the citizenry punishing a company for
the mistreatment of its workers than I do a government composed of legislatures dependent on campaign contributions. I would also put pressure on the SEC to investigate and shut down companies for criminal activity regardless of their political connections.

Attention on a Local Issue

The Hampton City Council has ignored a successful petition from the citizens of Hampton in regards to the citizens' attempts to keep Buckroe Beach open to the public. This is not about development, but about illegality on behalf of the city. You can read much about this in the Daily Press by doing a search for 'Buckroe'. I encourage this type of citizen action against illegal decisions by local governments. Below is the text of a press release from the petitioners against the city's action:

February 11, 2010

BUCKROE BEACH BAYFRONT PETITIONERS SUE CITY AND DEVELOPER
TO ENFORCE ZONING LAWS

The Buckroe Beach Bayfront Park Committee, whose successful Petition forced City Council to repeal a zoning ordinance that would have allowed a housing project on the property, have invoked the protection of the law again in an effort to save the property.

The Committee, and its five representative members, filed a suit today in the Hampton Circuit Court against the City of Hampton and developer POH 2010 LLC, contending that the two are permitting the construction project to go forward in spite of zoning to the contrary.

The suit alleges that the City Council’s original rezoning ordinance No. 09-0238 was approved on June 10, 2010 for the express purposes of providing the necessary zoning predicate for the Parade of Homes construction development on the Buckroe open space.

The suit further contends that when over 7,300 Hampton voters signed a Petition under the City Charter seeking either the repeal of the Ordinance or a Referendum by the City’s voters, the Council relented on the development project and repealed the earlier zoning change.

According to the suit, notwithstanding the Council’s restoration of the original zoning classification for the Buckroe Beach property which does not allow such a housing development as proposed by the developer, the developer is moving forward with such plans with the City’s express permission and consent.

The suit seeks a ruling from the Court that the City’s and the developer’s actions are in violation of the existing zoning laws and are therefore unauthorized and unlawful.

The Buckroe Beach Bayfront Park Committee vows to pursue its fight to protect this last piece of Buckroe bayfront open space as far as the law permits. The Committee stresses that not only is the preservation of environmentally critical open space at issue, but in light of the City’s actions in the face of the Council’s reversal of the zoning, the very integrity of the Hampton City government and its fidelity to its citizens is implicated as well.

CBC members, I wanted to introduce myself. My name is James Quigley and I am currently collecting signatures in order to appear on the ballot and unseat Bobby Scott in the 3rd Congressional District of Virginia. That aside, I wish to applaud your actions in regards to pushing for debt forgiveness for Haiti. Thanks to your work, and the work of others, Haiti has been forgiven for $1.2 billion within recent years. However, according to the fine folks at jubileeusa.org, Haiti still owes more than one billion dollars to various banks and organizations. As you well know, nearly half of this debt is from the regimes of "Papa Doc" and "Baby Doc", which were finally deposed more than twenty years ago.

The images shown from the recent tragedy that devastated Haiti were heartbreaking to many Americans, myself included. If there can be something positive that comes from this, hopefully it can be through the goodwill of Americans to send help through private charities. There was a statement from one CBC official that read: "At this stage, the information on the ground is still unknown, and until authorities can get a grasp on what is needed, 'in kind' donations have been discouraged." I would hope that you do not agree with this statement, and that you are finding ways to facilitate "in kind" donations, which constitute goods and services rather than money. If people wish to donate tools, canned food, and even donate their time to travel and provide aid they should be encouraged to do so. Such aid may even make a difference sooner than any kind of monetary donation routed through the government and international agencies before going through the Haitian government, and finally to the people in need.

Finally, I hope that we can take an opportunity during this crisis to address the debt of third world countries, whether just across our border such as in Haiti, or various other countries in Africa and Asia such as Liberia and Afghanistan. The World Bank and the International Monetary Fund (IMF) exist largely through our funding and representation, but these international financial institutions loan money out to government administrations that are unable to pay off the debts during their rule. This is profitable for the institutions that make up the World Bank and IMF, but is rarely beneficial for the citizens stuck with footing the bill. Some of the more corrupt governments then use loans from these international institutions to pocket money for bureaucrats or to finance a patronage system that corrupt officials use to stay in power. After these corrupt politicians leave, the citizens of their third world countries are left to foot the bill causing further poverty. For example, the large majority of the debt that has to be paid by current Haitian president, Rene Preval, came about before he had been elected. With his capital in ruin, his main port in greatly damaged, and his nearest airport in shambles, the chances for President Preval to revive his economy look grim. Now is the time to offer a helping hand to Mr. Preval and the people he represents and seek forgiveness for debt incurred by previous corrupt administrations. Currently, the World Bank and IMF still drag their feet in regards to debt forgiveness to Haiti. In fact, the IMF has given indications that some of the so-called “disaster relief aid” that will be provided will be given as debt that will further impoverish Haiti’s future while enriching that of these international banks.

I hope you agree that no corrupt government should be allowed to run up massive debts unless in time of war or other such crisis. We should not encourage a financial system that allows a corrupt government to steal from its future generations in order that the officials in charge can pocket the money or can give it to its political allies while leaving the bill to its citizenry. Once I am elected, I hope you can join me in reexamining the role of the IMF, the World Bank, and other international financial institutions and what this system of banking is doing to the people of impoverished countries. I am also sure that the American citizens who are footing the bill for the IMF and World Bank would also like to see foreign aid go to the people it is meant to help instead of unaccountable international organizations.

After my victory, I hope we can find similar issues we find commonality with and that I can add as fresh a perspective as I have above.

James Quigley responds to recent NEFMC decision on scallop industry















Attached is my official response that was just sent out via mail to the Chairman of the NEFMC. I would like to thank Councilwoman McMillan, Mr. Ed Mullis, and Mr. Ross Paasche for educating me about the situation.






I would also like to thank two members of my campaign team CCed in this letter, Mr. Kelly Place, a local waterman and environmentalist, and Mr. Timothy Schettino of CESIPI for doing the research that was a great help in drafting this letter.
